Why he should step down as Chief Minister if Guruji (Shibu Soren)lost the Tamar seat by 9032 votes. Those who demand his resignation assumes that art 164(4),is applicable to both ministers and chief minister and he should win an election to continue as Chief Minister.
Shibu Soren became Chief Minister on August 27 and he can continue till February 26 to complete six months. If Governor can give him a day’s break on 27.02.09 he can again be sworn in as Chief Minister for another six months and one more break will take him to March next year, the end of present assembly or the last break period can be managed as care taker Chief Minister for which one need not be a member of Assembly.
This is not a satire or wild imagination but a probability in our present Indian situation
Article 163 and 164 or any other articles of our constitution do not specify that a chief minister should be a member of assembly. According to constitution, chief minister is appointed by governor and other ministers are appointed by governor on the advice of chief minister .Assembly is in no way related to selection of chief minister. Same is the case with Prime minister and parliament. We need urgent modifications to our constitution specifying selection of Chief Minister and Prime Minister by concerned houses otherwise our democratic set up will crumble down on these ambiguity
